Legal Question in Criminal Law in California

My husband is serving a LWOP in the state of California. He was convicted of a murder in 1995. Nothing began until 1999 and that time they used another case against him from 1997 in the murder case. We are trying to see if there is a chance for at least changing his LWOP.They said that he was known for making weapons in prison and that he provided the weapon used in the murder, they found a weapon in his cell in 1997 and that was used against him. He was given the LWO due to the three strike law. Any help at all would be great.

I would say you need to talk to an appellate attorney. One on LawGuru is Edward Hoffman (310) 442-3600 Good luck!

Any help should have been requested at the time of trial, or in a timely appeal for trial error, not 13 years later.. Only newly discovered evidence of proof of innocence could now be raised on appeal, if at all.
