Legal Question in Criminal Law in California
identity theft charges
What is likely to happen for a person who is charged with identity theft. The charge came about due to 3 credit cards being obtained by a person in another persons name. Could this be reduced to credit card fraud? what is the typical senctence for a first time offender? I know that there are min. jail times for a person who used an I.D. and other min. times for a person who didn't use an I.D.
Is there any way to avoid jail time?

Re: identity theft charges
The outcome of any criminal case depends on many factors, including the facts of the case and whether or not the defendant retains a private attorney. Maybe you can find a lawyer who takes credit cards (yours).
Re: identity theft charges
Depends upon the damage to the victims, restitution made, your prior criminal record, among other factors. Yes, jail time is possible, so hire yourself experienced defense counsel if you want to have the best chance of minimizing the punishments. Contact me if interested in doing so.
Re: identity theft charges
As both other lawyers have said, each case will be determined by the facts of the case, the individual characteristics of the defendant (the person charged), and many other factors. It is impossible to predict an outcome based on as little information as you've given here. However, the one thing that's certain is that you need an experienced criminal lawyer to represent you. Ideally, that lawyer should be familiar with the court you will be appearing in. Most criminal lawyers give free consultations. If I were you, I would arrange to speak to 2 lawyers and then decide how you want to proceed. If you'd like to talk to me about your case, don't hesitate to call or email me and we can set up a free consultation. Good luck.
