Legal Question in Criminal Law in California

Is it illegal?

Say a newspaper has a comment section. Is it illegal to post the links to someone's social networking profile on the comments section? Something like ''Jane Doe is so ugly look at her profile'' and than insert the link. Is it illegal if the profile is public? This was done 1 time.

Re: Is it illegal?

I don't think what was done is either a crime or actionable (meaning no civil liability). It is not libel, as ugliness is simply a matter of opinion and taste. Like, I could say the poster's sense of humor and ethics are "ugly". Just my opinion, but not a lie, not slander, not libel. But legal or not, surely "this person" has better and more worthwhile things to do with his/her life than try to be "clever" and hurt other people gratuitously. Now THAT is ugly.

Re: Is it illegal?

It may not be 'illegal' but it is certainly a crude, ugly and offensive thing to do, showing no class or maturity at all. It could also subject the person to suit for invasion of privacy or slander.

Most newspapers have moderators who remove comments that are defamatory -- or just plain mean.
