Legal Question in Criminal Law in California
Use of Illegally Obtained Statement
If the police coerse a statement from someone that's
charged with a crime and that statement implicates
someone else in that crime, can the statement be used
against the second party even if a court determines it
was coersed and could not have been used against the
individual that made the statement?

Re: Use of Illegally Obtained Statement
The defendant's attorney needs to know all the facts in order to be able to answer such question intelligently. Without knowing all the facts, any answer is at best a guess. Only the defense attorney can make any use of the facts, by filing appropriate motions and proceedings. If the defendant needs to hire an attorney, contact me to discuss the defenses available, costs, etc.
