Legal Question in Criminal Law in California
Informal Probation for Petty Theft then DUI
About a year ago I was involved in some bad stuff, punch line I have a misdemeanor for petty theft. I was placed on informal Probation for 3 years I believe. Then about a week ago i was in a single car crash and apparently I was drinking ( Im still lacking memory for about a week around the crash, I understand that is no excuse). No one else involved only me.
-Single car
-BAC .111
-And I did submit to the test with the officer.
-Im only 20 years old
Im curious to know what exactly I am looking at.
Thank you for you time

Probation violation and mandatory penalties on the DUI, including fines, programs, loss of license, etc. You should get legal counsel to minimize the damage.

The main thing you need to worry about is your DUI. Your main problem is that you are under 21 and there is a high chance you will have your license suspended for 1 year. You should have your case evaluated by an attorney. There might be grounds for fighting your case such as illegal stop or arrest. Perhaps the BAC test results could be invalidated. You have a lot at stake and getting a lawyer involved is advised.
You are also looking at having to take some serious alcohol program classes and significant fees and fines. With a good lawyer you should be able to avoid jail time. I am presuming this is your first DUI offense.
Your informal probation is probably less of an issue considering that it is for a completely different type of crime than DUI although it will not be helpful to your situation for sure. However, if the theft and conviction took place in a different county, you probably do not have much to worry about.
