It is a felony punishable by several years in state prison. Probation is possible if you have a good lawyer and clean or relatively clean criminal record.

Most insurance fraud is committed by insurance companies; they can be fined or, at least theoretically, can lose their licenses. Individuals who commit insurance fraud can be fined, jailed, and/or sued.
