Legal Question in Criminal Law in California
I invested in a merchant services company called elite company USA-merchant services. I still ent five thousand dollars. I was told this whole a Credit card unit to someone. That I would get a monthly check for a portion of their charges starting January 2017. I received a commission check for one machine sold. I haven't received any payment. I see other complaints about this company on a ripoff report website. Can I sue for fraud?
1 Answer from Attorneys
Sure, if you can actually find the company [if it actually legally exists] to be able to sue and serve them, and to be able to find any of their bank accounts or real assets to be able to collect on a judgment if you get one. You did get one payment, so you probably have their bank account info and company ID from that check. The amount you lost would indicate you can file in small claims court for breach of contract without an attorney. If this is really a scam by someone hiding behind a phony internet page, good luck.
