Legal Question in Criminal Law in California

I had jus got caught no my s 2nd offense. my 1st one was a felony. i finished my probation for the last case. for petty theft. i work fulltime and have to kids i take care of by myself. Is there a possible way for me jus to get comm. service or able to do weekends and probation again?Or will i have bno choice but to do jail time

I'm sure the county will find a foster home for your kids while you do your time. If you are lucky they will place them with a relative of yours. Start asking your relatives.

While anything is possible, what is likely is a different discussion. You have a prior felony 'strike' making this new charge into a felony as well, if the DA chooses to charge it that way. Your attorney's job will be to try to negotiate a plea bargain that keeps you out of prison, but that is up to the DA and Judge as well.
