Juvenile Case - Grand Theft & Vandelism
My son (11 yrs) is being prosecuted by the county DA's office for grand theft and vandelism of a musical instrument.
It took us approximately 3 weeks before we actually obtained the police report.
As stated in the report and the staements made form parties involved, the scenario played out like this:
Myson's and friends statement:
My son was walking home from school, passing through a public park with 2 other friends and noticed a musical instrument (flute)and it's case sitting in a trash can by a baseball field. They thought they found something cool and picked it up and tried to use it. They couldn't figure it out so began to play catch with it (threw it around), subsequently it was eventually thrown back in the trash.
The victim's (13 yrs)statement went as such: She had asked a friend to watch the flute so that she could go ''play'' and left it in the care of another student.
Other student statement:
Didn't want to watch the flute, so decided to take it and ''hide'' it in a safe place, which happened to be in the trash can.
The victims father happened to be a Sgt in the local PD, and believed to push the charges.
Can we beat these charges?

Can you beat them? You'll never know until you present a proper defense. Witness credibility will be a large factor. Feel free to contact me if interested in firing counsel and doing this right.

Too little information for a conclusion..you do need counsel immediately.
My practice is limited to homicide defense.
