Legal Question in Criminal Law in California

Juvenile convictions appearing in background checks

Hello,

I was wondering whether juvenile convictions will be shown to others when doing federal (NICS) background checks.

I have been told by a couple sources that DOJ (state) background checks do not show juvenile convictions to any agency except law enforcement or the military (they do this, I've been told, because no other agency may consider juvenile records and so the DOJ does not even show it to them) I called the board of nurses which I will be applying to for licensure and the lady told me this was true.

However I have heard nothing about this for the NICS system. I will be doing clinicals in a state hospital that does background checks through the NICS. If the NICS has different rules they may allow other agencies to view (and therefore consider) my juvenile records. This will be a major problem for me as my record is not and can not be sealed. I would like to know if the NICS also blocks juvenile records or if they are allowed to show them.

I apologize for this rather complicated question. Many thanks for any helpful response!

Re: Juvenile convictions appearing in background checks

NICS uses DOJ records, so the info should be the same, as should the rules on what is shown.
