Legal Question in Criminal Law in California
juvenile probation
My son was in a fight at his baseball field in May of this year. The police informed us that no charges were being filed against either party so we didn't pursue it. The police assured me that my son would not have anything on record since there were no charges filed. However, we received a letter in the mail that said the police referred my son to probation. Can they do that if we never even knew there were charges? He is 12 years old and the other kid hit him first but they are charging my son with assault and battery according to the letter. They never interviewed any of his teammates at the field so how can they have a case?

Any answer you get to your general info question is of no value to you. The only legal advice that anyone should give you is: Exercise your 5th Amendment right to SHUT UP, and hire an attorney for him. If charges are filed, or interviews are demanded, do not speak a word to them; let your attorney. DA's will be happy to tell you that 95% of their convictions are made using the statements of people made while thinking they are being cooperative. Hire a lawyer as they intend to file charges. A good lawyer might be able to resolve your case without any charges or convictions.
