Legal Question in Criminal Law in California

my lawyer got arrested!!!!

I hired a lawyer and paid him a $5000 retainer. I was due to go to court in a week for my preliminary for having illegal fireworks. Apparently he got in trouble for bribery. I called him to get my money back, so I can hire a different attorney and he told me to kick rocks since he already went to my arraignment. Do I have any way to get my money back or am I screwed?

You would be entitled to some of your money back, however you may not get all of it back. I would advise you to put in writing a letter that states you have hired another attorney and that you deisire an accounting of his time that he has spent up till now on your case and you demand a refund of all unused monies within 2 weeks from the date of the letter. Hopefully the attorney will be ethical and give you an accounting of his time and a refund of all unused monies. You will probably have to pay the new attorney first and wait some time for the refund. Hopefully it will all go the way it should. Call me with any further questions. Two ways to go: small claims or state bar arbitration. Both are free to you. Your chances should be good especially is there is no written agreement.

File a fee dispute claim with the local Bar Association office. They will help you. They MAY be able to call him and get you a refund in time for you to use it to hire someone else. If not, go through the process however you have to.
