is it legal procedure or someone to have a grand jury inditment without their lawyer being present.

It would be very unusual for the defendant's lawyer to be present.

It is very rare for the accused to either be present or have a defense attorney present during a grand jury hearing at all. There was a web page I read the other day pointing out that the grand jury system has become abused in this country. http://www.nacdl.org/CHAMPION/PRESPAGE/98apr.htm
