Live Scan background check
I am applying for a state license and have to do an F.B.I. and DOJ Live scan background check. My record is clean accept for a class c misdemeanor citation I got on an indian reservation about three years ago in a different state. Do you think that the incident will show up on the FBI livescan?

It may. Since it was on an Indian Reservation it may have fallen under federal jurisdiction. If you are interested in what others will see on your check, you can request your DOJ printout and see what's there. You can go to the California DOJ website and you will find the instructions for requesting your background check. Go to http://www.ag.ca.gov/fingerprints/ and you'll find the instructions.

Yes, unless they failed to report it to the DOJ. Unless you are SURE it was not entered into the database, your failure to report it on your application could result in license denial and disqualification for 'perjury' if the agency discovers the problem.

Potentially it could appear on the report. However, if it doesn�t you may have a much larger issue in the future for not disclosing it if and when they discover it.
