Marijuana Possesion - deferred?

Myself, along with 3 friends were given tickets for possession of marijuana. We were in a car, with less than even a gram of marijuana. I�ve heard the fine will be somewhere around $300, but my main concern is not the fee. I�ve heard about some kind of deferment program that would keep this off of my record, is there any information available on this? This was my first offense of any kind. I may be disqualified for financial aid at my school and future schools if this goes on my record. Also, what are possible worst case scenarios? Do I have to go before a judge?

There is an option to get a deferred judgment under Penal Code Section 1000. If this is the first drug offense, and you do not have a prior conviction for felony, it is possible to enroll in a rehab program, and upon successfull completion any record of the arrest and conviction will be expunged. However, if you want to be a peace officer you will have to reveal the arrest on application.

If you were cited for a violation under the Vehicle Code, and you were under 21 at the time of the citation, you will be facing a mandatory suspension of your drivers license. The fine is still $100.00. You should get yourself a lawyer. Possible worst case scenarios are that you foolishly plead guilty, have the case go on your record and turn in your drivers license to the Judge. Get that lawyer. Good luck.

Your right, under the new federal student loan laws, if you have any conviction that are drug related you can cease to qualify at all for federal student aid. This is something that you do not want to skimp on and hope the results are good on the cheap. Take the time to find an attorney you feel comfortable with, because it is important to protect your rights here, and hopefully protect your ability to receive student id, which your entire future could depend upon.
