Legal Question in Criminal Law in California

In May2011, a no contact order was placed on my fiance for DV. He was sentenced to 5yrs in state prison. Must serve a manditory 85%. How can I get this no contact order lifted that I never wanted? Given his situation, would he qualify for early release under thw prison realignment order?

We need additional information. Who placed the no contact order on your fiance? Was it a civil restraining order or was it a criminal restraining order. When does the order terminate? Realignment took effect October 2011 and will not affect your fiance.

You don't, or at least it is unlikely you can.

The DA had it issued, over your objection, so the court knew that at the time. You could hire counsel to file a Motion to modify the order, and give it your best shot. If serious about hiring counsel to help in this, and if this is in SoCal courts, feel free to contact me.

That has nothing to do with early release or not. You can check CDC to see his projected release date, which has those computations accounted for.
