Legal Question in Criminal Law in California
Misd: Serving Alcohol to a Minor
A friend is a career bar manager at a prestigious restaurant. He has been sighted (via ABC Decoy program) for serving a minor. He has taken the ABC class, and had his staff take this as well. Is there any way to approach the court and ask for leniency given it's a first offense in 10 years as a wine bar manager and he has further educated himself and his staff? He does not want a misdemeanor on his record. In the future he plans to open his own wine store and takes this issue very seriously.

Re: Misd: Serving Alcohol to a Minor
There are a variety of negotiating techniques that can be used by an attorney. So he is well advised to hire one fast.
And while the conduct you describe might work to reduce certain consequences or penalties for his actions, once the law is broken, it is unlikely that the charges will just be dropped. However, an experienced attorney needs to be consulted to review the case and determine what the conduct was and the procedure/manner in which the authorities conducted such an investigation.
Please have him contact my office if he would like a consultation.

That is what attorneys are for, presenting defenses and issues to the court.
