Legal Question in Criminal Law in California

Misdemeanor Conviction

I plead guilty to a misdemeanor violation in January of 1997. At the time I was told that the conviction would come off of my record in January of 2004. Since researching it I have found that I need to actually get it expunged from my record. What is true?

Re: Misdemeanor Conviction

You must take action to expunge, it is not automatic. Contact me if interested in discussing the facts and fees for doing so. As long as your probation is now over, and you have no subsequent arrests, it is likely I can get it expunged.

Re: Misdemeanor Conviction

Thank you for your inquiry.

If your case was a driving case, such as a DUI or a driving on a suspended license, it is true that the case drops off your driving record (with the DMV) after seven years.

The court will continue to have a record of your criminal conviction, however, until you expunge it from your record.

I hope that this helps, but if you want more information, have other questions, or want legal representation to handle your expungement, please feel free to email me directly at [email protected]. I am happy to help in any way that I can.
