Legal Question in Criminal Law in California
Getting misdemeanor expunged for job.
My manager changed jobs & asked me on with her because of my hard working. So I filled out the paper work & put in my 2 weeks.(wasn't thinking)Paper work took over 2 weeks to get back to her. It wasn't good. She couldn't do anything to hire me directly because of 2 misdemeanors 2 years ago. Now I'm working there but as a temp. No benefits, lot lower pay &, not permanent. I need to get on permanent. Some how expung at least one misdemeanor so I can qualify.
My manager pushes me to do so. For my interests & the company's.How can I make this happen? Thank you.

Re: Getting misdemeanor expunged for job.
By filing the appropriate pleadings and petition with the court(s) involved, supported by facts and declarations. Some charges can be expunged, some can't. If you were a minor, the process is not available, but your juvenile records should be sealed. Feel free to contact me if interested in doing this right. If expunged, you get to say 'no' to convictions on most private employment applications.

You should definately think about expunging your misdemeanors, for several reasons, one of which is that you can legally say you were not convicted of a crime. My office handles these frequently, and we would be happy in helping you with this.

It will require filing and and a hearing. You could do it yourself, but it may be cheaper to hire an atrorney do it. What county have the charges? If in L.A., Orange, or San Diego Counties I may be able to do it for a nominal fee. Call me directly at 16192223504.
Re: Getting misdemeanor expunged for job.
contact the probation department in the county in which the conviction occurred and request information about expunging a misdemeanor. In Santa Clara County you fill out the form and submitted it along with the necessary payment, I believe it is $100 or less, and they will then submit the request to the court. It takes about 90 days for the request to be processed and sent to court for signature. If you successfully completed probation your request should be granted without a hearing.

It's a simple form and maybe a hearing, depending upon the circumstances. It should be a nominal fee (say $120 if no hearing) for an attorney to assist you.
