Legal Question in Criminal Law in California

misdemeanor on job apps

I was caught with a very small amount of pot(misdemeanor posession) and have taken a defferal class. Now my case is dismissed, am I allowed to answer ''no'' when asked '' have been convicted of a misdemeanor'' on a job application? This happened 22 months ago.

Re: misdemeanor on job apps

If you have explained the situation correctly then your case was dismissed. What this means is you were given diversion and as a result you may answer no to a question asking if you have been convicted of a misdemeanor. However, if you have not explained this correctly your situation may be different. I would suggest you take your paperwork to an attorney and get a consultation to find out exactly how your record reads before you apply for a job. Good luck

If you never pled guilty or no contest or if you did plead but it was expunged, generally, with only 3 exception, you can say you never were convicted of a drug offense. With any further questions, contact me at my website at www.wallinlaw.com. Thank you. David Wallin

Re: misdemeanor on job apps

If actually 'dismissed', then there is no conviction to report. If not, then contact me about getting it expunged.
