Legal Question in Criminal Law in California

Misdemeanor & becoming lawyer or teacher

Will an expunged misdemeanor stop me from becoming a teacher or a lawer? It has been five years, it has nothing to do with stealing, drugs or involving children but its still not pretty. Please advise as to if I can still apply to become a teacher? I also plan to attend law school next year would I be able to work in either profession. Does expunged mean sealed?

Expungement helps in your situation but it does not solve your problem. You will still need to reveal the offense on your applications and explain its circumstances if applying to be a teacher or lawyer. A misdemeanor will not necessarily disqualify you. How hard it will be depends upon the nature and facts of the crime.

Depending on the nature of the offense probably it won't stop you, but you might be in for some hassle; and if you need something expunged, or defended, in the first place, call.

Expungement is not the same thing as sealing.

The California Bar evaluates each potential member for his or her moral fitness. Having a criminal record won't necessarily lead to your denial, but having your record expunged won't necessarily lead to your admission. After all, it is quite possible to be an immoral person without ever being convicted of a crime. I would need to know more about the facts before I could even begin to assess your chances. But even if you ultimately pass this part of the Bar's scrutiny, the process may take some time and require significant effort on your part.

I have no idea what standards you would need to meet in order to become a teacher, so I can't say whether an expunged conviction for some unspecified misdemeanor will be an obstacle.

It's up to the agencies and employers involved, based upon the charges and facts of the case, whether they will license, credential or employ you. You must fully disclose to them all expunged cases when applying for any govt license or credential, bonding, security clearance, etc.
