misdemeanor

my nephew received a citation for shoplifting. he has no other record and am wondering upon appearing in court is their a possiblity of having that not reflect on his record. he did pay restatution to the store. also if you appear on a misdemeanor and the officer does not show up can it be dismissed like a traffic citation

If he is a minor, then the record can later be sealed. If an adult, he can seek 'expungement' once he completes all terms of probation. It's wishful thinking that the prosecution witnesses wouldn't show up at trial. They don't have to be present until then, and you don't really want to push this all the way to trial on that 'dream'. Cut a deal with the DA using your facts.
