Legal Question in Criminal Law in California

misdemeanor

my son has a misdemeaner non-traffic ticket for being in a park after 10 pm-no drugs alcohol or vandalism involved

if he goes to court & pays the fine what happens? is a misdemeanor on his record forever? will it hurt employment opportunities, can it be expunged? this is new to us & we haven't got a clue. Please help. Thank you.

If your son is under 18 then no, the misdemeanor conviction can be removed from his record when he has completed his probation and is over 18 years of age. If he over 18 years old then the misdemeanor can only be removed from his record if petitions the court to do so after he has completed probation.

Since it is a criminal misdemeanor I would recommend speaking with a lawyer in your area before pleading guilty to the misdemeanor.

If he pleads or is found guilty, then after his period probation is completed, he will be able to petition the court for 'expungement' of the record. He should get counsel to represent him now, to try to get it dismissed or dealt with without conviction. Contact me if interested.

Have your son represented..although a juvenile misdemeanor may not appear significant...it can often result in the Court placeing the juvenile on probation...many times counsel can negiotiate resolutions that are much superior to "just paying the fine"...

Juvenile records can be sealed after the juvenile attains majority...
