Legal Question in Criminal Law in California

Moved out of state and unaware of pending felony

What happened if you moved outta state and come to find out during a background check that you have a pending felony charge against you on 5 counts. Unaware of the situations, never had a criminal history, but an ex may have gotten you involved? What can you do to clear your name without appearing?

"Clear your name without appearing?" You don't. Personal appearance is mandatory on felony charges. Hire counsel to accompany and defend you when you come back to handle this properly. BTW: warrants are forever. You'll be arrested on the warrant any time you come in contact with police.

How you can proceed from here depends on the charges and what court your case is in. Normally an original warrant requires that you turn your self in to be booked on the charges. Depending on the charges and the court you may be released on your own recognizance. Or, you may be required to post a bail. Normally a felony requires that you appear in person at each court appearance. However, if the court allows you can appear through your attorney with a signed PC 977 form.

You should talk to a lawyer in the area where your case is oending to find out what options you have in that particular court.

Good luck,
