Our office has handled 100's of these type of case. Most likely the police report has statements by him that seem to indicate that he knew he hit the animal. Call me at my office at 661-267-1313, and we can talk about all the facts on the phone. .............. David Wallin
Of course you can fight the charges. Raise your defenses with whatever witnesses, evidence, facts and sympathies are available. While this isn't a 'capital case', you certainly face potential jail and fines, so handle it right. If you don't know how to represent yourself effectively against an experienced prosecutor intending to convict, then hire an attorney that does, who will try to get a dismissal, diversion program, reduction, or other decent outcome through plea bargain, or take it to trial if appropriate.
If serious about hiring counsel to help in this, and if this is in SoCal courts, feel free to contact me. Ill be happy to help, using whatever defenses there may be. I've been doing this for several decades now.
