Legal Question in Criminal Law in California

I have a niece of 13 years old she has a mental problems, she was in a hospital because she always has dreams the always said that she have to kill her self or her sister and now she told the social worker that she get out of control because she fall sleep and she feel tha some body was touching her and went she wake up my brother was there so now her mom make a police report but my brother said that he never touch her. My questios is he can be charge for that and what we can do?

CAN he be? Of course. The question is whether there is any evidence to support charges against him. He must exercise his 5th Amendment right to SHUT UP, and speak only through an attorney.
