Legal Question in Criminal Law in California

non consentual sex that was video taped while I was unconcious

How difficult is it to prove without reasonable doubt that a person sexually assaulted me with an object, video taped the whole thing, but the only part of his body that is in the video is his hand that was holding the object? There is also some audio of him whispering about what happened in the video. It is clear that I am unconscious, but his face is not in the video. Can a hand and thumb plus voice recognition be used as sufficient evidence?

It sounds like more than enough evidence to bring to the police, and probably enough to prosecute your assailant. Call your local police department, explain what happened and what evidence you have, tell them who did it and make an appointment to show them the tape.

Good luc.

Try to file a criminal complaint. Then it's up to the police and DA to prove if they can. You could also sue, but there are financial realities to consider before suing someone without substantial assets and income.
