Legal Question in Criminal Law in California
In october 2012 i was arrested for one night on a DV felony charge In april 2013 i pleaded no contest and was charged with a misdemeanor. I did 52 weeks of DV classes and was order $2800 for restitution. Someone left a package hanging on my door last week, no one was home, its a summons. She is sueing me on 5 charges regarding the same case. They requesting a 4 days judy trial and want more than $25k. Can she do this? Was my attorney slow in not covering me against this during the DV case? Im already ordered to pay restitution and i am on time. Advice pls

It is not the same case. She has filed a civil case against you. There is a difference between a criminal case and a civil case. I suggest you speak to a lawyer immediately. You have 30 days from the time the summons and complaint are served on you to file responsive papers.
Can she?? Of course. This is a personal injury case based upon her damages. Hire an attorney to defend you asap.
If serious about hiring counsel to help in this, and if this is in SoCal courts, feel free to contact me. Ill be happy to help fight and get the best outcome possible, using whatever defenses and sympathies there may be. Ive been doing these cases for many years, and handle cases from San Diego to Los Angeles.
