Legal Question in Criminal Law in California

parole out of state

I am a parolee in California. I lived in Nevada for a year prior to my incarceration. I have a husband, minor children, a home and a job there waiting for me. My husband contacted Nevada Parole and they said they would probably accept me. I owe restitution. My parole officer says no way can I transfer home. i tried to put myself on calendar to ask the judge to waive the restriction to be in California per P.C. 11177 (c). The county won't let me put myself on Calender they say I am out of their jurisdiction. My Parole officer says I have to stay here and he won't put me on calendar. I have no home here no job no family support no income....all of which I have in Nevada. I am not being allowed to parole and become a successfu; parolee. This was my first offense. I am a forty-nine year old married woman who has learned her lesson. How can I get home to where I will be able to do this successfully? I meet all the requirements of the Interstate Compact to transfer but my agent is being difficult. I was even able to go home to Nevada per the judge for 6 months while going to court prior to sentencing. Ventura, Calif. was not my last legal residence, Nevada was. Help me go home and do this successfully....any suggestions?

Re: parole out of state

You will have to have counsel file an appropriate motion requesting a court order. No guaranty, but if you have written proof of consent and acceptance of the NV parole/probation office, and if the court agrees it would be in the interests of justice, then you have a chance of transfer. Feel free to contact me if interested in doing so.
