Thank you for your posting on LawGuru.com, and the opportunity for me to help you by responding to your posting.
The answer to your question is that with an outstanding warrant, your friend can be arrested at any time, for any reason. So, while he can get his passport, traveling to and from Mexico across the border may be a problem.
I hope this helps. If you do have other questions, feel that you need legal representation, or want legal advice, please feel free to email me directly at [email protected]. It's my pleasure to help in any way that I can. Thank you.
Re: Passport and bench warrants
Duh, no, and if he crosses the border or comes in contact with law enforcement anywhere, he'll be cuffed, arrested and transported to jail and then court. That's what 'arrest warrant' means.
