Even though he was charged with a misdemeanor, a conviction for child abuse can haunt your fiance for years. You need to get him a good criminal defense attorney in your area. Act quickly so his lawyer can start gathering evidence and fighting this bogus charge.
Re: pcm273a(b)
We are suffering an epidemic of false domestic violence complaints in this country. It is all too easy to get a man arrested on a false accusation, even where the police ought to know it is fabricated. I get a lot of these.
You SHOULD take this charge very seriously. It can have MANY consequences for the rest of his life. Ideally, he should fight it as hard as he can, get the charge dismissed or get acquitted and then petition for a judicial finding of factual innocence. That will result in the actual physical destruction of every record of the arrest and charges.
Otherwise, it will impact many areas of his life: professional licenses, jobs, social contacts, community organizations, scholarships, insurance rates, security clearances, and so on. That arrest, if left on his record could even prevent him from being a scout master for his own children later on, not to mention how police will treat him in any traffic stop.
If you are in the San Francisco Bay area, please give me a call for a free consultation. Or see these articles on my web site for further information on your fiance's situation.
