Legal Question in Criminal Law in California
penal code 459 burglary
my brother was picked up last month on a burglary charge from 2004. He was picked up a month ago after serving time on a different charge. The D. A. is telling him that they found a finger print outside of the house on a window screen and the print did not match to him untill recently. All they have is this one finger print on the outside of the house but he is on parole and has priors for burglary. He is fighting the case right now. We would like to know if they are going to be able to convict him with only one print and it being on the outside?
