Legal Question in Criminal Law in California

Person Moved from Calif. to Florida Owing Me A Lot of Money

Thank you for taking the time to answer my questions. I sold a house in Calif. to a person in 2001. He represented in a signed document that he had $100,000. cash as a downpayment. It was a lie. The sale of my house only came about when I extended a personal loan to him for $52,000. which he promised to repay in a signed document through a series of postdated checks. $30,000. of the checks bounced and he refused to make good on them. I found out he just sold the house and moved to Florida with no forwarding address. Two Questions: How can I find this person since no one has a forwarding address or phone number ? When I find him, what specific criminal charges can I ask the D.A. in San Jose or in Florida to file against him (intent to defraud ?) Thank you very much for your help.

you should consult with counsel to see what you can actually do about setting aside the property transfer, and/or suing. However, it sounds like you let a pro get to you, so it probably will be difficult to recover your money. The authorities local to the house are the ones that have to start criminal proceedings, if you can convince them to do so. They could help you find the person, if they wanted to.
