Re: pettey theft with a prior
Petty theft with a prior is under Penal Code section 666. It's a "wobbler" and can be either a felony or a misdemeanor.
If it's a felony, you face up to 3 years in state prison. As a misdemeanor, it's a maximum of 1 year in county jail.
What you'll actually get depends on your record, the facts of the case, the jurisdiction, the judge, the DA and frankly, your attorney.
Given that you've got at least one theft on your record, you're most likely looking at custody time if convicted.

Potential jail or prison time, depending upon how it is charged, and what the outcome is. Suggest you get an attorney before going to court.
