Legal Question in Criminal Law in California
"I" am a police officer who embezzled approximately $1000 from my department through an account in my trust. i replaced the money, but am being investigated. can i go to prison?

Theoretically you could go to jail or prison, but it's unlikely. You need to consult a criminal defense lawyer right away, preferably someone who also has experience in administrative disciplinary hearings for law enforcement officers. My best guess is you will be fired, convicted of a misdemeanor theft-related offense, be placed on probation,.and it will be difficult for you to find future employment. If you have a drug, alcohol, or other problem for which there is a support group available, start going to meetings and get proof of attendance each time.
I agree with Mr. Stone. Better get an attorney who knows what a "Skelly" hearing is, ASAP.
Of course. That is a potential. As is termination, loss of pension, etc.
�What can you do�? Hire an attorney, unless you know how to effectively represent yourself in court against a professional prosecutor intending to convict. You've seen them in action from the other side. No amount of free 'tips and hints' from here or anywhere else are going to effectively help you in your defense, other than the advice to exercise the 5th Amendment right to SHUT UP and do NOT talk to anyone except an attorney about the case. Most police and prosecutors will happily tell you that 95% of people convict themselves by trying to be 'helpful and cooperative', either during initial contact, questioning, interview or interrogation.
