Possesion of a controlled substance
I was recently arrested (and later released on O.R.) during a traffic stop for possessing a controlled substance without a prescription. Specifically I had 1 Adderall tablet that is prescribed to me by a psychiatrist but did not have proof of the prescription with me. I have since obtained proof from the pharmacy (Walgreens). I could, but haven't at this time, notify my doctor to obtain additional proof. I have not yet appeared in court (date is set for 1/2/08) and am not sure if I can appear with proof and clear up the matter or if it's more complicated than that. What would you advise?

You should Stop acting as your own attorney and hire one immediately.

If the prescription actually covers the time period of the arrest, then take a copy to court and request the charges be dismissed. It may require you appear more than once to get it accomplished. It should not be a problem. However, if the DA and court refuse to dismiss, then you will need an attorney; if so, feel free to contact me for help.

You can definitely try to resolve the case yourself on your first date in court. You might need to do it through a public defender. If it is more complicated, there are always lawyers . . .
