Possession of Illegal Fireworks
I was citied for possession of illegal fireworks. The penalty is no less then 500 no more then 1000 dollars or up to 1 year in jail or both. Now i have no criminal record but have a D.U.I. from about six years ago. i have no problem paying a fine but will i have to go to jail? I will lose my job and alot more. I have no prior criminal record other then the D.U.I. So i am very anxious about it.
what should i do? thank you for your help in advance.

It is unlikely that jail time will be ordered. A misdemeanor may be resolved by a retained attorney with you ever even having to appear in court. Call me directly at (619) 222-3504.

Every law has a minimum, and a maximum. This, however, is not a promise that you will get either the minimum or a maximum. Although it is generally true that a prior criminal convicton will affect the likelihood that you will get a more serious sentence, the fact that it was so long ago, and was an unrelated crime, makes additional punishment unlikely.
A good attorney can typically get you alternative sentencing, such as community service, electronic confinement, work furlough, weekends, caltrans, etc., IF you qualify, and only after reducing any jail time to as low as possible, if not to zero. For that reason, as well as your peace of mind, I must recommend that you at least consult with an attorney to go over all your options.
