Legal Question in Criminal Law in California

private attorney

if this private attorney offered to handle a criminal case total $4.000 but only gave him $2.000 down and we signed no agreement paper work and we have not went to the Preliminary hearing yet do i still have to pay him the other $2.000 only because i feel he has not done anything so far for the $2.000 we gave him and money is tight what do i do?
