Legal Question in Criminal Law in California

probation

Hello - I was convicted for narcotic sales in 2001, and served 3 months in jail. When I was released I was on felony probation, however; i never had to report, i never had to go drug test all they wanted was for me to pay a certain amount every month, and they left me alone. Just recently I was convicted of under the influence a misdemeanor , and yet this case seems so much more serious than the other one. I will be on a supervised probation( and be required to report and test. This is a petty case compared to drug sales why does the probation dept treat it as if it's more serious tha a drug sales charge? I don't understand why supervised rather than court probation? Doesn't that seem a little backwards?

Re: probation

You were jailed for three months last time but you only got probation this time. I don't understand why you think the current case is being handled as if it were more serious than the last one.

Re: probation

Because you have a prior 'strike' and are now a repeat offender.
