Legal Question in Criminal Law in California
My probation is over - now what?
Dear Sir/Madam:
In June 5 of 2003, I plead no contest to (misdemeanor) 422pc (criminal threats). I was given 3 years probation and paid a $390.00 fine which included that my firearms be confiscated and that I do not use, own or possess a firearm or other dangerous weapons.
It has been over 3 years now and my question is do I need to have my conviction expunged or can I purchase a firearm now that I have completed my probation?
Thanks in advance.

Re: My probation is over - now what?
No, you can NOT purchase, own, possess, handle, or be in the presense of, a firearm or ammunition without committing a felony. You can seek expungement of the conviction, which would help when you apply for private employment, if granted. But an expungement doesn't allow you to own a firearm again. Only if you seek and obtain a 'restoration of rights' to own a firearm, can you do so. Contact me to discuss the costs and facts of doing so, if seriously interested.
