Legal Question in Criminal Law in California
probation relating
I would really appriciate if you could help me answering these questions.
My wife is in jail for the last 2 months due to a drug related and probation violation crime. Somebody has put a hold on her bail. Her prliminary hearing is in next month on the Jan 29. I really like to get her out of the jail. I would like to know...
Who puts (and can take off) a bail hold?
or
Who do we have to contact to remove the hold?
Can a probation officer take off a no-warrant probation (violating probation)hold or bail warrant off?
What is the difference between probation hold, no hold, no bail hold??

Re: probation relating
Some assumptions here,
If your wife is in custody on a felony probation violation, it is possible, but certianly not required that she be jailed without bail. If not done already, your wife may need to calendar a bailr reduction/OR release hearing...through Counsel.
Depending on the offenses at issue, your wife may be eligilble for many different drug programs and I am curious why her prelim is so far off???
Sorry, just not enough info to be more precise.

Re: probation relating
Since she has a prelim hearing set, she has already been arraigned. She either has a private attorney or an assigned PD. YOu should be asking them, they know the facts, and can set appropriate bail review applications and hearings.
