Re: professional prescription addiction

The crimes that you described fall outside the scope of Prop 36, the "Prop number" that deals with addiction. There is one Business and Profession Code section, I believe, that is covered by Prop 36 and deals with possessing fake prescriptions. Perhaps a deal can be worked out where your family member pleads guilty to that section. If you wish to contact me for further clarification, or to discuss the case further, please do so.

Your pharmacist/relative needs the best lawyer he can afford! He/she is in deep s*** as the Pharmacy Board will cut no slack if there is a conviction. Nor will the court. However, this is not a prison or county jail case, it is a "preservation of license" case where your lawyer fights until he wins, or gets a deal that will assure no harsh Board discipline. I have done these cases for doctors, pharmacists and others successfully. Check the experience level of the lawyer you hire in these kind of cases. They are unique (for doctors, dentists, pharmacists and other licensed health care professionals).
