Legal Question in Criminal Law in California

What is the punishment for an adult male uncle who chokes out (restricts air until the person passes out) on a 12 year old girl in California. He wasn't playing around, he was upset because she wanted her cell phone back that he was using. Then when she woke up with her face on the cement he was laughing at her

If you haven't already called the police, shame on you. This would be an aggravated assault or attempted murder punishable by a substantial state prison term.
