Legal Question in Criminal Law in California

Question

How do you defend yourself against penal code 484b? I was an officer of corp. and buisness simply went out of buisness. We didn't file BK. Certian clients didn't get work performed that gave money. Now I'm personally being charged with 484b, 487 and a couple other buisness and professions code violations. Help??

By hiring experienced counsel, unless you want to try practicing 'brain surgery self taught'. You face jail and other penalties. Are you thinking you're going to stumble through the court process hoping for anonymous helpful hints that will make it magically disappear? Your attorney can use whatever defenses your facts and evidence provide.

You start with consulting a good lawyer. Only a lawyer who has reviewed the facts of your case can properly advise you.

The offenses you speak about generally require some pre-existing criminal intent to defraud on the part of a defendant. They do not stand if a situation involves a company which simply runs out of money to pay its debts. The evidence of a criminal intent can very circumstantial if not speculative, however.
