Legal Question in Criminal Law in California

Questioning from a Detective at work

I'm an aide in a handicapped classroom. During class the other day myself another aide and the teacher were questioned by a Detective about abuse allegations made against the teacher. Before I went in to talk I asked to have a union rep with me and the detective wouldn't let me.

Thanks! Kiddoadvo

Re: Questioning from a Detective at work

There is no obligation to speak to police. You can politely give your name and tell them you don't wish to talk to them without either your union rep or an attorney present.

They cannot force you to answer anything. In particular, if they are asking you questions about alleged abuse, how can you be certain they are not trying to elicit an incriminating response from you?

I recommend you hire a lawyer.

Best of Luck.

Exercise your 5th Amendment rights to SHUT UP, and hire an attorney to speak for you. You face charges that could put in in jail/prison, and most police and prosecutors will happily tell you that 95% of people convict themselves by trying to be 'helpful and cooperative'. If youre serious about hiring counsel, feel free to contact me.
