Legal Question in Criminal Law in California

Record Clearance Firearm ownership

I will be completing my DEJ program soon. Is it true that DEJ records felony or misdemeanor get removed automatically upon successful completer of the program?

Can a person legally own a firearm after the DEJ program?

Re: Record Clearance Firearm ownership

Clearance of convictions depends on the terms of YOUR program, nothing is automatic.

IF you end up with NO convictions on your record, then you MAY be able to own firearms. You need to get the answers to that from the court as to the conviction and terms of your program, and then from DOJ as to your eligibility, and do so BEFORE applying to purchase a firearm. There is a 'pre-purchase check' you can do through DOJ. If you are a 'prohibited person' and try to buy a gun, you commit a new felony and will be arrested.

If your program did not specifically state that your gun rights were restored, you may be able to bring a motion in court to try to get them restored. Feel free to contact me for the legal help you'll need if that occurs.
