Legal Question in Criminal Law in California

Record expungement

Hello. I work in the securities industry and am looking for a new job. Because of the patriot act, they are now a lot stricter about who they hire and I just got turned down for a job because of a misdemeanor. I was picked up for shoplifting close to 7 years ago when I was in college. I wanted to get the record expunged, but the court clerk told me that even so, employers will be able to see the record. Is this true that there's no way to completely get rid of it?

Re: Record expungement

Expungement results in the case being dismissed, so for most purposes you can then say you were never convicted. However, it is still available for inspection during security clearances, govt investigation, bonding, police, etc. So, if they have the right to look into the records they will see it. Most private employers don't have that access. If you want it expunged, contact me to discuss.
