Legal Question in Criminal Law in California
record exsponged
I am trying to pursue a career in Pharmacy Technician but was told you can have no drug charges and I have one in 2004 and I was at the wrong place at the wrong time so they charged us both with this, I was wondering if I could possibly get my record exsponged so I may pursue my career. I was on a three year probation and I completed it and now am no longer on probation. Is this possible to get my record cleared of this. If not I will be devastated. Please help with any information on this.

It should be no problem no expunge your record. One should always expunge whenever first opportunity arises. For example, it might become more difficult to do it later if you picked up some new charges. Feel free to call to discuss how your record could be expunged.
You will also need to look into whether expungement will eliminate the conviction for the purpose of obtaining your license - something an attorney could investigate for you.

Depending upon the actual charges, I can probably help you get it expunged, meaning changing the record to show conviction reversed and dismissed after the fact. HOWEVER, even if expunged, you still will have to disclose all convictions on applications for your professional licensing, schools, hospitals, nursing homes, bonding, security clearances, government, etc. Then it is up to them to decide whether the conviction bars you from entry. Expungement allows you to say 'no' to conviction on many private employment applications, so it is certainly useful. Contact me if interested in doing so.
Re: record exsponged
If you completed your probation without any probation violations and you are not on probation for any other offense you will be able to get the conviction dismissed. That is frequently referred to as an expungement, however that does not release you from all criminal consequences. I know you are interested in pursuing a career as a pharmacy technician. I am assuming that requires licensing by the state of california. If so, it is important to check with the licensing board to see how a dismissal/expungement will provide you enough relieft to move forward to get the license.
Re: record exsponged
I have had a number of clients who have faced this issue. I have even represented a few people before the Board of Pharmacy as part of my Administrative Law Practice. It is possible to get a license with certain drug convictions, but it depends on a number of factors, including the actual charges.
Getting an expungement will help. However, you will need both an expungement and, depending on when you apply, someone to help you through the application process.
I recommend hiring an attorney to do both.
