recording a conversation
Can you record a conversation, without the persons knowledge over the phone and then use what they said against them in a court case?

No, but you can be prosecuted for making the recording -- which would then be used as evidence against *you*.

Such unauthorized recording is both a state and federal felony for which you can go to prison.
