Legal Question in Criminal Law in California
removing a misleading criminal record
When I was a minor - age 20 - I was arrested for suspicion of starting a
forest fire that was put out a week before I entered the area for the first
time. When searched during my arrest, I admitted to having a pistol in
my luggage. With a nolo-contendere plea I was convicted of carrying a
concealed weapon and fined $25. I was told the conviction would not
be on my record. Then on a rainy day in Keni, Alaska, I sat in an
abandoned shack with no doors or windows and ate my lunch. I was
arrested for ''burglary'' and released later the same day with the charges
dropped. Both incidents remain on my record today -- almost 40 years
later -- the conviction for carrying a concealed weapon and the arrest
for burglary. How can I get this record expunged?

Re: removing a misleading criminal record
If the pistol conviction was in California, you may be able to have the Court expunge the record by filing the appropriate Petition, generally done by an attorney that knows how to do so. If it is in CA, and if you are interested, contact me. As to the Alaska charge, you will need to speak to an attorney practicing in that state to see if the same process is available to you there.
